Acceptance of Terms
These Terms of Use (“Terms”) govern your access to and use of the AVANA platform, including our website, applications, AI-powered tools, content, and related services (collectively, the “Services”).
By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, you must not use the Services.
These Terms form a legally binding agreement between you and AVANA (“AVANA”, “we”, “our”, or “us”), operating under the laws of the Republic of Indonesia.
Who We Are
AVANA is a technology platform providing AI-assisted insights, data aggregation, and informational tools related to investment, real estate, and business opportunities.
AVANA is not a broker, advisor, agent, or fiduciary, and does not act on behalf of users or third parties.
Eligibility & Legal Capacity
To use the Services, you must have the legal capacity to enter into binding agreements in your jurisdiction.
If you are not legally permitted to provide consent under applicable law, you may only use the Services with the involvement and consent of a parent or legal guardian.
By using the Services, you represent that you meet these requirements.
Registration & Accounts
Certain features may require registration or account creation. You agree to provide accurate, current, and complete information and to keep such information updated.
You are responsible for all activity conducted through your account and for maintaining the confidentiality of your credentials. AVANA is not responsible for unauthorized access resulting from your failure to safeguard account information.
Use of the Services
Permitted Use
You may use the Services solely for lawful purposes and in accordance with these Terms.
Prohibited Use
You may not:
Use the Services for unlawful, misleading, or harmful activities
Misrepresent AI-generated content as professional, human, or guaranteed advice
Scrape, extract, harvest, or commercially exploit platform data without authorization
Reverse engineer, decompile, or attempt to access underlying systems or models
Interfere with security measures, access controls, or usage limits
Use the Services to develop or train competing products, datasets, or models
Content & User Inputs
You may provide information, prompts, inquiries, or other materials (“User Content”). You represent that you have all necessary rights and permissions to provide such content.
You are solely responsible for User Content and for ensuring it does not violate applicable laws or third-party rights.
License to AVANA
By submitting or generating User Content through the Services, you grant AVANA a worldwide, non-exclusive, royalty-free license to use, host, process, analyze, transform, and store such content for the purposes of operating, maintaining, improving, and developing the Services.
This license survives termination of your use of the Services to the extent necessary for lawful business operations.
Data, AI Outputs & Intellectual Property
You retain ownership of your personal data, subject to our Privacy Policy.
However, AVANA exclusively owns all rights, title, and interest in and to:
Aggregated, anonymized, and derived data
Statistical insights, benchmarks, and analytics
AI models, system improvements, methodologies, and outputs at a system level
Platform usage trends and non-identifiable intelligence
These assets constitute AVANA’s proprietary intellectual property and may be used, licensed, transferred, or sold as part of the business, including in connection with a merger, acquisition, financing, or asset sale.
Informational Nature of the Services
AVANA provides informational tools, data, and AI-assisted insights designed to support research and decision-making.
Information presented on the platform is derived from a combination of publicly available professional sources, industry data, government publications, and third-party materials that AVANA reasonably believes to be reliable at the time of use.
However, information and AI-generated outputs may be incomplete, outdated, subject to change, or interpreted differently depending on context.
AVANA does not provide financial, legal, tax, or investment advice, and nothing on the platform constitutes a recommendation, offer, or solicitation.
Users remain solely responsible for evaluating information, conducting independent due diligence, and making their own decisions.
AI-Specific Disclosures
Due to the nature of artificial intelligence and data aggregation systems:
Outputs may not be unique, complete, or fully accurate
Similar outputs may be generated for different users
Results may vary depending on inputs and data sources
AVANA continuously works to improve accuracy and reliability but does not guarantee outcomes or results.
Suspension & Termination
AVANA may suspend or terminate access to the Services, with or without notice, if:
These Terms are violated
Required by law or regulation
Use of the Services poses legal, security, or reputational risk
You may stop using the Services at any time.
Disclaimer of Warranties
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”
TO THE MAXIMUM EXTENT PERMITTED BY LAW, AVANA DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF ACCURACY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, AVANA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR EXEMPLARY DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES.
AVANA’S TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU (IF ANY) FOR THE SERVICES IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
Business Transfers
In the event of a merger, acquisition, financing, reorganization, or sale of all or part of AVANA’s business or assets, data and intellectual property (including aggregated and anonymized data) may be transferred as part of the transaction, subject to applicable law.
Governing Law
These Terms are governed by and construed in accordance with the laws of the Republic of Indonesia, without regard to conflict of law principles.
